The Samsung Galaxy S4 could be pulled if Apple succeeds in its latest patent spat with the Korean manufacturer.
Apple has stated that the Samsung Galaxy S4, along with 21 other Samsung devices infringes its patents.
Apple said in a statement, 'Based on Apple's analysis of the Galaxy S 4, Apple has concluded that it is an infringing device and accordingly intends to move for leave to add the Galaxy S4 as an infringing product.' The company continued, 'Apple will eliminate (without prejudice) one of the Accused Products named herein, so that it will continue to accuse only 22 products of infringement at this stage of the litigation.'
Almost every Samsung Galaxy smartphone is included in Apple's list, and the company said it is hoping to swap one device out for the Samsung Galaxy S4 to keep to its original number of offending devices.
In this recent filing, Apple argues that Samsung should not count different network versions of a device as different phones. Using the US as an example, Apple wants Samsung to count the S4 on Verizon as the same device on the Sprint network.
'According to Samsung, for example, the Galaxy Nexus activated on Sprint must be counted separately from the Galaxy Nexus activated on Verizon.' Apple explained.
Apple isn't accusing the whole Samsung Galaxy line as infringing patents, but instead choosing individual devices to take action against.
This isn't the first Samsung vs. Apple case we've seen in the courts - last year, Apple has been trying to sue Samsung for one thing or another since April 2011.
The last case saw Apple trying to block the Samsung Galaxy S3 from shipping, while Samsung then decided to attack the iPhone 5.
